Botswana’s authorities intensify crackdown on illegal decoder sales

In a coordinated enforcement action led by the Botswana Police Service and the Companies and Intellectual Property Authority (CIPA), authorities raided five shops in Molepolole suspected of selling OpenView decoders illegally. The operation resulted in the arrest of five foreign nationals, all of whom admitted guilt, and paid Admission of Guilt fines.

During the raid, police confiscated several OpenView decoders and remote controls units. The raids aim to target perpetrators who violate Section 27 of the Copyright and Neighbouring Rights Act, which states that acts such as re-broadcasting, communication to the public, and fixation and reproduction of fixations of broadcasts, require authorization from rightsholder.

Botswana has a zero-tolerance approach to intellectual property violations and illegal activities. These raids should serve as a stern warning to those engaged in illegal sale of OpenView decoders in Botswana.

We remain fully committed to supporting enforcement actions and ensuring that individuals or outlets engaging in unauthorized sales are held accountable. For her part, MultiChoice Botswana MD Stephanie Pillay said, “MultiChoice Botswana fully supports CIPA’s enforcement actions and will continue to assist in identifying and prosecuting individuals selling illegal MultiChoice decoders. Protecting intellectual property is essential to ensure the integrity of our industry and to safeguard the interests of law-abiding customers and businesses.”

A Broader Fight Against Piracy
This recent operation underscores Botswana’s commitment to combating piracy and illegal activities. Authorities have noted the detrimental impact of counterfeit goods and unauthorized sales, including Undermining the legitimate market and economy and Depriving the government of tax revenue.

CIPA and the Botswana Police Service continue to lead the charge in eradicating piracy and intellectual property violations. An economy free of counterfeit and pirated goods stimulates innovation, attracts investors and creates sustainable business enterprises and permanent employment.
